TERMS & CONDITIONS - COMMISSIONING CLIENTS
1 The photographs, contained on these discs, are for sole use by the
commissioning client who is given an internal licence to use the images for
all their company©ˆs literature (e.g. company brochures, leaflets, annual
reports, trade fairs, web-site use (low resolution only), entry for industry
awards, lectures, office display, presentations and portfolio use etc.).
2 Reproduction rights are not granted exclusively to the client except when
specified on the invoice.
3 Photographs in any format must not be sold, given or loaned to any third
party. All third parties (e.g. consultants, contractors, clients,
architectural journals, newspapers, magazines, book publishers* etc.) are to
be directed to VIEW where several sets of camera originals will be lodged.
VIEW will supply photographs to all third parties who will be asked to pay
reproduction fees depending on the kind of usage required.
4 The photographs are not to be used for press releases or advertising
without permission.
5 Copyright remains the property of the photographer in accordance with the
1988 amendment to the Copyright act.
6 The author has asserted his right to a credit in accordance with sections
77 and 78 of the Copyright, Designs and Patents Act 1988. A credit is always
to be acknowledged whenever the photographs are reproduced to read:
copyright "Chris Gascoigne/VIEW"
7 Additional prints, duplicate transparencies and 35 mm lecture slides can
be obtained from Chris Gascoigne directly or VIEW Pictures Ltd, materials
will be charged.
8 Photographic material remains the property of the photographer until full
settlement of the invoice for the work.
9 The photographs shall be presumed to have been received in good condition,
unless within 3 days of receipt the Supplier receives notification of any
discrepancy or damage.
10 This agreement shall be subject to and construed according to English law
and the parties agree to accept the exclusive jurisdiction of the Courts of
England
